Article 1 - Scope and pre-contractual information

These general conditions of sale (the "GTC") apply to the sale of jewelry items (the "Products") concluded between the company GC BOUTIQUE SAS, hereinafter referred to as "GIGI CLOZEAU" and only consumer Customers; namely non-commercial individuals (the “Client(s)”) from the website www.gigiclozeau.fr

No special condition can, without prior written acceptance by GIGI CLOZEAU, prevail over the GCS, so that all contrary conditions set by the Customer will be, in the absence of prior written acceptance by GIGI CLOZEAU, unenforceable against the latter.

GIGI CLOZEAU reserves the right to modify the GCS at any time, the modifications then being applicable to orders placed after the online publication or communication by any other means of the modified GCS.

Any order of Products implies the pure and simple acceptance of the GCS.

The Customer acknowledges having had communication, prior to ordering the Products, in a readable and understandable manner, of these GCS and the information listed in Article L.221-5 of the Consumer Code and in particular the following information:

- information relating to the identity and full contact details of GIGI CLOZEAU;

- the essential characteristics of the Products offered for sale;

- the price of the products and the terms of payment;

- the methods of delivery and processing of complaints;

- the procedures for exercising the legal warranties relating to the Products;

- the terms and conditions for exercising the right of withdrawal and the form established for this purpose.

The T&Cs are written in French, which alone is authentic.

 

If any provision of the T&Cs is declared null and void or ineffective on any legal grounds whatsoever by a court of law or any other administration or authority, such a decision will in no way affect the validity of the other provisions.

 

The fact of not exercising, at any time, a prerogative or a right recognized by the GCS, or of not requiring the execution of any stipulation of the present can in no case be interpreted, nor as a modification of the present, nor as an express or tacit waiver by GIGI CLOZEAU of the right to exercise said prerogative in the future, or of the right to require the scrupulous execution of the commitments subscribed to herein.

Article 3 - Products

The Products offered for sale by GIGI CLOZEAU are described and presented on the Website.

Although GIGI CLOZEAU makes every effort to ensure that the photographs present on the Website are faithful and up-to-date reproductions of its Products, the Customer is expressly informed of the fact that the said photographs, illustrations and indications (in particular of dimensions and/or or colors) are given for information only and cannot therefore constitute a contractual commitment, nor any guarantee on the part of GIGI CLOZEAU, on the perfect similarity between the Products ordered by the Customer and the photographs, illustrations and indications appearing on the Website or in emails sent by GIGI CLOZEAU.

In any case, the Customer is invited to contact GIGI CLOZEAU at the contact details referred to in article 2 above for any questions and/or additional clarifications concerning the Products.

Article 4 - Orders – Formation of the sales contract

Any Customer of the company declares to have the capacity to contract under the conditions described below, that is to say to be an emancipated minor or to be of legal majority and not to be protected within the meaning of article 488 of the Civil Code.

The order can only be registered on the Website if the Customer has clearly identified himself by entering his Customer identifier (email address) and his/her unique password, which is generated each time the Customer logs in.

If you are a new Customer, you must enter your email address in the "Log In" section to create a personnel customer account. You will then receive a unique code valid for 15 minutes to log in. You will receive a new code each time you log in. 

The Customer is responsible for the accuracy and completeness of the information entered and entered on the Website, and in particular the information necessary for the identification of the Customer, his name, his first name, his postal address, his email address. , its complete delivery address, its valid telephone number and its billing address, which are essential for the processing of the order and its delivery.

Consequently, GIGI CLOZEAU cannot be held responsible for any defect, delay and/or non-conformity of delivery linked to inadequacies or errors in the information entered.

The provision of personal information necessary for the processing and delivery of orders is mandatory.

The ordering process takes place in the following steps:

1.Order Entry : You select the Product(s) of your choice and add them to the shopping cart; you can at any time check the contents of your basket, the corresponding price and make any useful changes. The next step is to identify yourself if you have previously created your account or you will then have to create your account.

Then, you enter and validate your delivery address. You choose your delivery method, you validate it. Please note, if you choose delivery to a relay point, the choice of the relay point is made after payment has been made. By clicking on the "continue to payment" icon and seeing a summary displayed on the screen, you validate your order (1st click).

Then you choose the method of payment by following the instructions on the Website. You acknowledge that placing the order entails an obligation to pay according to the method chosen.

You definitively confirm your order, by a 2nd click after having checked it, and if necessary corrected, by clicking on the "pay now" tab to demonstrate your commitment, your knowledge and your acceptance of the GCS and the purchase made.

The last step is to choose your relay point if you have chosen this delivery method.

As of this confirmation, the sales contract between GIGI CLOZEAU and the Customer is concluded. The order is submitted to GIGI CLOZEAU for processing and can no longer be canceled or modified by the Customer subject to the conditions relating to the right of withdrawal referred to in Article 8 below.

In the event that the debit of the price, including all taxes and costs is impossible, the online order will be immediately canceled, without the Customer being able to make any claim in this respect.

2.Order confirmation : We send you an "order confirmation" by e-mail containing an identification number of your order, the identification of the products ordered, the price expressed including all taxes including the price of the products as well as the amount including VAT of the delivery costs , the foreseeable delivery time (excluding public holidays and weekends) as well as the withdrawal form.

3.Tracking control : We invite you to follow the progress of your order on our Site in the "MY ACCOUNT" section. The indication of your username and an unique password will be necessary during each consultation.

4.Printing of the elements of your order : At the end of the ordering process, it is recommended that the Customer download, save and/or print the GCS, as well as the information relating to the order placed, as well as any message that we may exchange.

5.Delivery : We deliver the products ordered to you at the delivery address indicated when ordering, after receipt of payment for the order.

6.Cancellation or refusal of the order : We reserve the right to cancel or refuse any order from a Customer with whom there is a dispute relating to the payment of a previous order, or with whom a payment dispute is in progress, or any other problem detected on the Customer account or for any other legitimate reason relating in particular to the abnormal nature of the order.

Article 5 - Availability of Products

The Product offers and the prices proposed by GIGI CLOZEAU are valid as long as they are accessible on the Website and only within the limits of available stocks.

In the event of unavailability of the Product(s) ordered after placing the order, the Customer will be informed by e-mail, telephone or simple mail as soon as possible upon receipt and validation of the order. The Customer may then, at his choice to request (i) either the cancellation of the order and the reimbursement of the price paid, (ii) or the delivery of an equivalent or similar Product in return for the price that he will have paid, possibly increased by an additional price or on the contrary reduced by a price reduction depending on the replacement Product chosen, (iii) either the establishment of a purchase voucher for an amount equal to the total price including VAT of the order, this voucher being usable during 3 years, excluding any other claim or indemnity whatsoever. The refund of the price paid or the delivery of the equivalent or similar Product will take place as soon as possible and at the latest within 3 working days from the choice notified by the Customer. In any case, if no response is issued by the Customer, the unavailable order will be automatically canceled at the end of a period of 10 days and the refund will be made under the conditions provided for in the previous paragraph.

Article 6 - Price and terms of payment

6.1. Price

The prices of the Products are indicated on the Website as well as in the order confirmation sent at the end of the ordering process.

The prices of the Products are indicated in euros (€) and in pounds sterling (£) for Great Britain and include all taxes (TTC) taking into account the VAT rate applicable on the day of the order.

The processing and delivery costs are the responsibility of the Customer and are indicated according to the shipping options chosen by the Customer in accordance with the indications of the tariffs.

For all sales made outside the European Union, and depending on the country to which the Products are likely to be delivered, it is specified that the Customer alone assumes the responsibility for payment of any import duties and taxes that may be applicable.

GIGI CLOZEAU reserves the right to modify its prices at any time, it being understood that the orders of Products will be invoiced on the basis of the prices in force, at the time of the registration of each order, as they will appear on the Website. .

6.2. Payment terms

The price of the Products including all taxes (TTC) plus any processing and delivery costs is payable in euros (€) and must be paid in full on the day of the order.

In the event that the debit of the price, including all taxes and costs is impossible, the online order will be immediately canceled, without the Customer being able to make any claim in this respect.

Constitutes a payment within the meaning of this article the effective provision to GIGI CLOZEAU of the funds corresponding to the price including all taxes (TTC) and all costs included.

1. Credit card

We accept payment by credit card. The credit cards accepted are those issued by Visa, Mastercard and American Express networks.

Payments are made by credit card with immediate debit.

Credit card payments are made through the secure payment system of the Customer's bank. The price including all taxes (TTC) and all costs included of the Products ordered is immediately debited from the Customer's bank card after verification of the latter's data, upon receipt of the debit authorization from GIGI CLOZEAU on the bank card used by the Client. The commitment to pay given by means of a payment card is irrevocable.

By communicating the information relating to his bank card, the Customer authorizes GIGI CLOZEAU or his service provider to debit his bank card for the amount corresponding to the total price, all taxes included (TTC) and all costs included, of the Products ordered. To this end, the Customer confirms that he is the holder of the bank card to be debited and that the name appearing on the bank card is indeed his. The Customer communicates the sixteen (16) digits and the expiry date of his credit card as well as, where applicable, the numbers of the visual cryptogram.

2. PayPal

We accept payments made via the PayPal platform. Your PayPal account must be set up and running properly for the payment to be authorized. You can also pay over the course of 4x free of charge, if the amount of your order is between 30 and 2,000€.

3. ApplePay

We accept payments made via ApplePay. Please ensure that your device and ApplePay account are set up correctly for the transaction.

 

In order to ensure payment security, the www.gigiclozeau.fr website uses the stripe secure solution for processing online payments. GIGI CLOZEAU reserves the right to suspend any order and any delivery in the event of refusal of authorization of payment by bank card on the part of accredited bodies or in the event of non-payment. GIGI CLOZEAU reserves the right to cancel or refuse any order and any delivery with which there is a dispute relating to the payment of a previous order, or with which a payment dispute is in progress, or any other problem detected on the customer's account or for any other legitimate reason relating in particular to the abnormal nature of the order.

The order form that the Customer establishes online or the order confirmation sent by e-mail to the Customer by GIGI CLOZEAU does not serve as an invoice. The Customer has the original invoice in his online account. The invoice is not attached to the package. GIGI CLOZEAU keeps an electronic copy of each invoice. In the case of delivery to an address different from the billing address, the invoice is in any case only available in the online order tracking of the Customer's account.

Article 7 - Product Delivery

The terms of delivery according to the delivery zones with delivery times and delivery rates are detailed in Annex 2 and include the following options:

Colissimo delivery with signature (excluding DOM TOM)

Delivery to a relay point - Metropolitan France (excluding DOM TOM)

DHL delivery with signature 24/48h (excluding DOM TOM)

The order is prepared and sent to the Customer after receipt of payment.

The delivery times described in Appendix 2 according to the delivery method and the place of delivery chosen are average times which may vary according to the availability of stocks, the nature of the order, the preparation and shipping time of the order as of the activity period.

The products are delivered to the address indicated by the Customer on the order form. The Customer must verify the completeness and conformity of the information he provides to GIGI CLOZEAU. The latter cannot be held responsible for any input errors and the consequences in terms of delay or delivery error. In this context, all costs incurred for the reshipment of the order will be entirely the responsibility of the Customer. GIGI CLOZEAU can not be held responsible for delays in delivery due to errors or disruptions attributable to carriers (including in particular in the event of a total or partial strike in particular of postal services and means of transport and / or communications).

GIGI CLOZEAU may be required to divide an order into several shipments depending on the availability of the Products and according to the terms defined in Article 5 above.

Deadlines are indicative; GIGI CLOZEAU nevertheless undertakes to make its best efforts to deliver the Products ordered as soon as possible.

Except in cases of force majeure, if the Products are not delivered within the deadlines communicated by GIGI CLOZEAU, the Customer may request in writing the resolution of the sale under the conditions and according to the methods of articles L.216-2 and L.216 -3 of the Consumer Code.

Any modification of the order accepted by GIGI CLOZEAU will necessarily lead to an extension of delivery times. Similarly, the delivery of the Products may only be postponed at the Customer's request with the prior written consent of GIGI CLOZEAU.

The Customer is required to check the condition of the packaging of the Products and the conformity of the Products delivered upon receipt.. The Customer must in particular express his reservations and complaints, once he has noticed an anomaly such as in particular a damaged package or packaging, a missing Product in relation to the documents attached to the delivery.

GIGI CLOZEAU reminds that it is the Customer's responsibility to inspect their packages upon receipt in the presence of the delivery person and to immediately notify the carrier and GIGI CLOZEAU customer service of any anomaly noted (shock, damaged package, delivery date not in accordance with the normal deadlines of the delivery service. In the event that such mentions have not been made on the delivery note presented to the Customer by the carrier, no complaint relating to the condition of the package(s) could be accepted a posteriori by Gigi Clozeau.

In the event of non-compliance of the Products in kind or in quality, the Customer must inform GIGI CLOZEAU Customer Service using the contact details referred to in Article 2 above.

Article 8 - Legal right of withdrawal - returns and withdrawal

8.1 Conditions for exercising the legal right of withdrawal

The Customer has a legal right of withdrawal without reason for any order of Products made from the Website in accordance with the provisions of Articles L.221-18 to L.221-28 of the Consumer Code, specifying the number of the order and contact details.

The withdrawal period expires fourteen (14) days after the day on which the Customer, or a third party other than the carrier and designated by the Customer, takes physical possession of the Product(s).

To be able to exercise this right of withdrawal, the Customer must, before the expiry of the aforementioned period of fourteen (14) days, notify GIGI CLOZEAU according to the contact details referred to in Article 2. of its decision.

To notify GIGI CLOZEAU of the decision to withdraw, the Customer will send by registered mail with acknowledgment of receipt or electronically to GIGI CLOZEAU:

- the withdrawal form in appendix 1 duly completed;

or

- an unambiguous declaration as to his desire to withdraw

The legal right of withdrawal provided for in this article does not apply to damaged and/or deteriorated Products, in such a way that the Products are unsuitable for new marketing.

8.2 Return of Products

Returns are free only for France within 14 days after receipt of your order within the limit of one return per order. Your return order must be posted within this period. After this time, we cannot guarantee that your return will be accepted and processed.

To proceed with the return: on the website in the section my account / my orders, click on return or exchange. For an exchange, fill in the Comment field specifying the jewelry desired in exchange : model, color, type of gold ans size. Exchanges are only authorized within the European Union.

Upon receipt of your request we will send you your return label.

You can the edit and print your return form. Returns are processed within fourteen (15) days of receipt of your order.

Return packages are your responsibility. This label is uninsured. If you prefer tan  insured option, you must use your own label purchased from your carrier.

The Customer's liability may be incurred in the event of depreciation of the Products and the impossibility of resale in the state resulting in particular from abnormal and excessive handling, or return of the Product in packaging of insufficient quality to ensure its protection, or return of a Product that does not conform to the Product shipped.

In any case, the Customer is invited to contact GIGI CLOZEAU at the contact details referred to in article 2 above for any questions and/or additional clarifications concerning the Products.

"Custom orders” are manufactured exclusively for the customer. When placing this order, the customer is informed that returns are not possible for custom-made products.

 8.3 Refund

In the event of exercise of the right of withdrawal, GIGI CLOZEAU reimburses the Customer for all sums paid, including delivery costs, with the exception of additional costs arising from the fact that the Customer has chosen, where applicable, a method of delivery other than the less expensive method of standard delivery.

GIGI CLOZEAU refunds the sums paid, at the latest, within fourteen (14) working days following the day on which it is informed of the decision to withdraw.

The Customer is informed that GIGI CLOZEAU reserves the right to defer reimbursement until (i) receipt of the Products or (ii) until proof of shipment of the Products is provided, the date chosen being that of the first of these dates.

GIGI CLOZEAU reimburses the sums using the same means of payment as that used by the Customer for the order.

Article 9 - Conditions of use of the Products

The Customer is required to comply with any instructions and precautions for the use and storage of the Products, as listed in the instructions accompanying the Products.

GIGI CLOZEAU products and jewelry are made by hand in our workshops. A French manufacturer that guarantees a level of excellence of a great jeweler. They should be handled with care and we recommend that you avoid any contact with chemical substances (perfume, lotion).

Any damage resulting from improper use by the Customer cannot be covered by GIGI CLOZEAU. In this case, an estimate will be communicated to him.

GIGI CLOZEAU cannot be held responsible for any damage occurring following use or storage contrary to the instructions and precautions communicated above.

Article 10 - Legal Warranties

The Products benefit from (i) the legal guarantee of conformity and (ii) the legal guarantee against hidden defects, in accordance with the provisions of the Consumer Code and the Civil Code reproduced in Appendix 3.

 

Under the legal guarantee of conformity, the Customer is informed of the fact:

 

  • that he has a period of two (2) years from the delivery of the Product to act against GIGI CLOZEAU;

 

  • that he can choose between repairing or replacing the Product ordered, subject to the cost conditions provided for in Article L.217-9 of the Consumer Code;

 

  • that he is exempted from providing proof of the existence of the lack of conformity of the Product during the twenty-four (24) months following the delivery of the Product;

 

  • that the legal guarantee of conformity applies independently of the commercial guarantee that may possibly cover the Products.

 

Under the legal warranty against hidden defects, the Customer is informed that he:

 

  • may decide to implement the warranty against hidden defects rendering the Product unfit for its normal purpose in accordance with article 1641 of the Civil Code;

 

  • can choose in this case between the resolution of the sale or a reduction of the sale price in accordance with article 1644 of the Civil Code.

 

Requests under the legal guarantee of conformity or the guarantee of defects of the thing sold are made by the Customer to GIGI CLOZEAU, by registered letter with acknowledgment of receipt, according to the contact details referred to in article 2 above.

The Customer must be in possession of the invoice or the certificate of authenticity to make a claim under the legal guarantees.

GIGI CLOZEAU's customer service will indicate to the Customer the procedure to follow and the documents and supporting documents necessary for the analysis of his claim under the legal guarantee of conformity or the guarantee against hidden defects of the thing sold.

Article 11 - COMMERCIAL warranty

GIGI CLOZEAU Products and jewelry are guaranteed for one (1) year from the date of receipt. The warranty covers a manufacturing defect (clasp, modification of the color of a resin bead, breakage of the chain) following a faulty workmanship or manufacturing defect.

The Customer must be in possession of the invoice or the certificate of authenticity to make a claim under this commercial guarantee.

Independently of this commercial guarantee, the Products benefit from the legal guarantee of conformity and the legal guarantee against hidden defects, described in Article 10 above and in accordance with the provisions of the Consumer Code and the Civil Code reproduced in the Appendix. 3.

Article 12 - Intellectual Property

The Customer is informed of the fact that all intellectual property rights (trademarks, know-how, trade secrets and other intellectual and/or industrial property rights), as well as any element relating to the design and sale of Products, protected or not within the meaning of the Intellectual Property Code, including the content, photographs and illustrations present on the Website belong entirely and exclusively to GIGI CLOZEAU.

Article 13 - Personal data - Proof and archiving

The information and data entered and entered by the Customer on the order forms are collected and collected by GIGI CLOZEAU solely for the purposes of processing, preparing and delivering the Products ordered.

This information and data may be collected and recorded in a customer file kept by GIGI CLOZEAU in accordance with the regulations relating to personal data.

The Customer has in any case and at any time a right of access, rectification, modification and deletion, limitation and portability of his personal data concerning him.

The Customer may exercise these rights by contacting GIGI CLOZEAU at the email address referred to in Article 2.

The Customer also has the right to lodge a complaint with the CNIL.

The archiving of orders and invoices is carried out by GIGI CLOZEAU on a reliable and durable medium so as to constitute a faithful and durable copy which will be kept for 3 (three) years from their collection. These orders and invoices can be produced as proof of the sales made.

Article 14 - Applicable law

These General Conditions and the sales of Products resulting from them are exclusively governed by the provisions of French law, to the exclusion of the 1980 Vienna Convention on the International Sale of Goods.

It is up to the Customer to take into account, for the interpretation or use of the information contained on the Site, the specificities of the law of his country of location if this was not France. GIGI CLOZEAU does not give any guarantee of compliance with local legislation that would be applicable to the Customer.

Article 15 - Settlement of disputes

For any dispute relating to the validity, interpretation, execution, non-execution, interruption and/or termination of these GCS and the sales of Products, only the French courts will be competent and determined in accordance with the rules of procedure. French civilians.

Any complaint must be sent by the Customer by registered letter with acknowledgment of receipt to GIGI CLOZEAU customer service at the address mentioned in article 2 above.

If he does not obtain satisfaction following the complaint sent, the Customer is informed of the possibility he has of submitting the dispute to a mediation procedure.

This mediation procedure, which is not a mandatory prerequisite before the introduction of a dispute, aims only to try to bring the parties together with a view to reaching an amicable solution.

Consequently, both GIGI CLOZEAU and the Customer remain free to accept or refuse the use of mediation, as well as to accept or refuse the solution proposed by the mediator and remain free to submit their dispute to a judge within the framework of the applicable legal provisions.

Article 16 - Promotional codes 

The promotional codes cannot be combined with each other, a code can only be used for a single order and a single customer. The promotional code cannot be re-used during a return or an exchange. 

Promotional codes are only valid on the gigiclozeau.fr website and are not valid at a reseller.

When a promotional code gives the right to a gift and not to a reduction on the value of the order, then in this case the promotional code is limited in time and within the limits of available stocks. It is also valid and applicable only on the customer's first order with the condition of subscription to the gigi Clozeau newsletter.

Annex 3 - Provisions relating to legal warranties

Pursuant to Article L.217-15 of the Consumer Code, articles L. 217-4, L. 217-5, L. 217-12 and L. 217-16 of the Consumer Code are reproduced below. consumption, as well as article 1641 and the first paragraph of article 1648 of the Civil Code.

The seller delivers a good in conformity with the contract and is liable for any lack of conformity existing at the time of delivery.

He is also liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation when this has been charged to him by the contract or has been carried out under his responsibility.

Article L.217-5 of the Consumer Code

The property complies with the contract:

If it is specific to the use usually expected of a similar good and, where applicable:

- if it corresponds to the description given by the seller and has the qualities that the latter presented to the buyer in the form of a sample or model;

- if it has the qualities that a buyer can legitimately expect given the public statements made by the seller, the producer or his representative, in particular in advertising or labeling;

Or if it has the characteristics defined by mutual agreement by the parties or is suitable for any special use sought by the buyer, brought to the seller's attention and which the latter has accepted.

Article L.217-12 of the Consumer Code

The action resulting from the lack of conformity is prescribed by two years from the delivery of the goods.

Article L.217-16 of the Consumer Code

When the buyer asks the seller, during the course of the commercial guarantee which was granted to him during the acquisition or repair of movable property, for a restoration covered by the guarantee, any period of immobilization of at least seven days is added to the remaining warranty period. This period runs from the request for intervention by the buyer or the provision for repair of the property in question, if this provision is subsequent to the request for intervention.

Article 1641 of the Civil Code

The seller is bound by the guarantee on account of hidden defects in the thing sold which render it unfit for the use for which it is intended, or which so diminish this use that the buyer would not have acquired it, or does not would have given a lesser price, if he had known them.

Article 1648 of the Civil Code

The action resulting from redhibitory defects must be brought by the purchaser within two years from the discovery of the defect.
